Summary of key decisions from the User Group Committee meeting on 10 April 2013

Judgment Publication Policy September 2013

Please note the contents of the Tribunal’s new Judgment Publication Policy. From 3 September 2013, the Tribunal’s Judgment will be published on the Tribunal’s website notwithstanding the fact that an appeal against the decision has been filed at the Administrative Court. A published Judgment will be endorsed to the effect that it is subject to appeal upon receipt by the Tribunal of notification from either party accompanied by a copy of the Notice of Appeal sealed by the Court. Once the appeal has been decided, the published Judgment will be annotated briefly to note the outcome and the Appeal Judgment reference. Judgments removed from the Tribunal’s website pending appeal under the May 2013 Judgment Publication Policy will remain unpublished until the appeal has been determined.

Guidance Note on Sanctions September 2013

The Tribunal’s Guidance Note on Sanctions has been reviewed by the Tribunal’s Policy Committee and minor amendments made with immediate effect to include references to the following cases:

Page 8, paragraph 26 – the addition of the decision of the Administrative Court in Ebhogiaye v Solicitors Regulation Authority [2013] EWHC 2445 (Admin.)

Page 10, paragraph 40 – the addition of the decision of the Administrative Court in Solicitors Regulation Authority v Emeana, Ijewere and Ajanaku [2013] EWHC 2130 (Admin.)

Page 13, paragraph 56 – the addition of the decision of the Administrative Court in Agyeman v Solicitors Regulation Authority [ 2012] EWHC 3472 (Admin.)
