Mr Venkatasamy denied the allegation he faced. The Tribunal found the evidence of the witnesses to be plausible. It did not prefer the evidence of the Applicant’s witnesses over that of the Respondent. Accordingly, as the Tribunal was not satisfied on the balance of probabilities that Mr Venkatasamy had misconducted himself as alleged, the Tribunal found the allegation not proved.
